OFFICIAL RULES:


1. No purchase necessary. Promotion begins on May 28,  2007 and ends on July  31, 2007. All entries must be transmitted on toytips.com no later than July 31,  2007  by 11:30 pm CST.


TOY TIPS MAGAZINE Sweepstakes is open to residents of the United States only, 18 years of age or older. Employees of toy companies or advertisers in Toy Tips and Parenting Hints Magazine or their advertising, public relations or promotional agencies (and their dependents and immediate household members) are not eligible to participate. 


2. Prizes and Odds of Winning.

One drawing will be held on or about August 10, 2007 for the following awards

from the respective TOY TIPS and Parenting Hints MAGAZINE Sweepstakes "Prize Sponsors."


1. One winner to receive 5 Pacific Cycle bikes for family members based on

age and gender.  Choices are limited to two adult bikes, two child bikes and one adult bike for a babysitter. Winner may choose the bikes from the collection pictured in sweepstakes page on toytips.com. This is valued at less than $500.


2. Two winners to receive a My Little Pony(R) Toy Collection valued at $250. 


3. Two winners to receive a Transformers (R) Toy  Collection valued at $250


4. One winner to receive a  Spider-Man (R) toy collection from amazon.com valued at $200.


5. One Winner to receive a  Steve and Barry's Gift Card valued at $250.


6. One winner to receive an  Ebay gift card valued at $50.


7. 2 winners to receive a Nordic Ware Bakeware Collection valued at $189.50. 


8. One winner to receive 48 bottles of Gain (R) Laundry Detergent valued at $250.


Substituting prizes is not allowed.  Prizes also may not be substituted, transferred, redeemed for cash, or exchanged except at the discretion ofby Toy Tips, Inc. and respectiveor the  Prize Sponsor in their sole discretion. Any applicable federal, state, and/or local taxes are the responsibility of the winner. Odds of winning depend on the number of entries received. Sweepstakes is void outside the United States of America. The drawing is conducted by Toy Tips, Inc.


3. Sweepstakes Entry


To enter, complete and submit electronically the online entry form at  www.toytips.com. The online entry form must be filled out completely in its' entirety to be eligible. Incomplete entry forms will not be accepted and are void. One entry per household is allowed. Entries submitted using bot or automated technology are ineligible and will be deleted.



4. Rules


Toy Tips Inc.  and Prize Sponsors assumes no liability or responsibility for late, lost or misdirected entries for any computer, telephone, electronic, hardware or software programs, network connection, Internet, computer malfunctions, failures or difficulties of any kind whether failed, incomplete, garbled or delayed either caused by Toy Tips Inc.  or human error or technical malfunction that may occur during transmission or in the entry process. 


All entries become property of Toy Tips Inc. and will not be acknowledged or returned.


Toy Tips Inc. reserves the right to cancel the sweepstakes at any time if a computer bug, virus, tampering, unauthorized intervention or other technical problem occurs or corrupts administration, security or proper play. Toy Tips also reserves the right to disqualify any entrant or person tampering with the entry process, operation or maintenance of the website who is otherwise in violation of the rules. 


5. Validation and Acceptance

The winner(s) in Toy Tips and Parenting Hints Magazine Sweepstakes will be selected in a random drawing. By entering the sweepstakes, participants agree to be bound by these official rules and all decisions of the judging process and organization. Potential winners  will be notified by email and have 14 days from the date the email is sent to respond for acceptance of the prize. An affadavit of Eligibility, release of liability and publicity release must be returned in order to receive the prize.  In the event of non-compliance, alternate winners will be randomly drawn.


6. Winner's List:

To find out who the winners are, visit toytips.com. All winners names will be published online. All participants must agree (if a winner) that his/her first and last name will be published in the winner's list on toytips.com.


7. Entrants' email 

No entrant's email name or address is sold or given to any third party for any reason. By agreeing to participate, each participant agrees to release and hold toy Tips Inc. harmless from all losses, damages, rights, claims and actions of any kind in connection with the Sweepstakes and any prize given resulting from acceptance, possession, or use in any prize, including without limitation to personal injury, death, and property damage and claims based on publicity rights, defamation or invasion of privacy. 


8. Disclaimer:

Toy Tips®  and Prize Sponsors do not endorse or warrant any product reviewed, nor are they responsible for any malfunction or injury associated with any product mentioned. Information provided is to assist in making informed purchasing decisions. When deciding on a toy or product for a child, be sure it is age-appropriate for the child and used safely with parental supervision. Keep all toys with small parts away from young children under age 5 or from any child that may put things in his/her mouth regardless of age. Toy Tips® is completely independent and does not derive any income from manufacturers to review their products. Toy Tips® does not accept entry fees or from manufacturers or their licensees to review products. This sweepstakes is void where prohibited by law.


9. CHOICE OF LAW.

This Agreement is governed by and construed in accordance with the internal laws of the State of Wisconsin (regardless of Wisconsin’s Conflict of Laws Principles) and without reference to any rules of construction regarding the parties responsible for drafting hereof.


10. RESOLUTION OF DISPUTES.

Both parties to this Agreement agree to submit all controversy, claims, disputes, and matters in question arising out of, or relating to, this Agreement, its performance, or its alleged breach, arising after the execution thereof to binding Arbitration.  Arbitration shall be in accordance with the Commercial Arbitration Rules of the American Arbitration Association except that all Arbitration proceedings shall occur in Milwaukee, Wisconsin.  The arbitrator may grant injunctive relief, but shall not be limited to such relief.  However, this Arbitration Agreement shall not preclude either party from seeking Injunctive Relief in a Court Order to protect its rights until such time as Judgment is entered upon an arbitration award, nor shall the filing of such an action constitute waiver of the right seek Arbitration.  The parties agree that the venue and jurisdiction concerning said requests for Injunctive Relief shall be solely in Milwaukee County, Wisconsin.  The unsuccessful party in said Arbitration or action for Injunctive Relief shall pay the other party’s costs related thereto including reasonable attorney fees.


11. NOTICES.

Any notices required or permitted under this Agreement shall be given in care of the applicant.  A notice shall be deemed given when deposited in the United States mail, postage pre-paid, addressed as indicated herein.


12. PARTIES BOUND.

This Agreement shall be binding upon and inure to the benefit of the parties and their respective heirs, representatives, and successors.  


13. ENTIRE AGREEMENT/MODIFICATION/WAIVER

The terms of this Agreement represent the total, complete and entire understanding between the parties with respect to the subject of the Agreement superseding all other agreement, whether written, oral or otherwise, between the parties with respect thereto.  This Agreement may be modified only in writing, signed and exchanged between both parties.  Compliance with the provisions of this Agreement may be waived only by instruments specifically referring to this Agreement and signed by the party waiving compliance.  No course of dealing, nor any failure or delay in exercising any right, shall be construed as a waiver, and no single or partial exercise of a right shall preclude any other or further exercise of that or any other right.
